SUMMARY:Consumer Duty – Time to put the people perspective under the microscope
DESCRIPTION:Through the recently published policy statement (PS 22/9) and finalised guidance (FG 22/5) the FCA have set out their requirements for the new Consumer Duty. The Duty is set to enhance existing rules with an aim of tackling the harms that the regulator believes exists in retail financial services markets\, but most importantly also their causes. \nWith rising expectations on Senior Managers with the introduction of a new consumer principle\, and a new Conduct Rule for all which by its nature demands a greater level of expectation across all employees\, this webinar once again will seek to consider the people perspective now that the final rules are available for discussion. \nWithout competent\, capable\, very well-trained individuals at all levels and across all roles\, firms will fail to effectively implement this new regime.  Obvious\, you might say\, but is it?  With many projects looking to implement technical regulatory change\, the focus tends to be on the detail\, not those that will implement\, manage and live with it on a day-to-day basis. \nIn the second part of our Webinar series\, once again the Worksmart team are going to be joined by guests for this event – Jeff Abbott (2be Development Consultancy /T-C News) and Lynne Hargreaves (Clearstep Consulting) for a lively discussion and a strong focus on the role of the individual in all that the FCA expects.Given the FCA’s responsibility for ensuring consumers are properly protected\, as a sector\, we are all well aware of the constant development of regulatory change that seeks to improve standards in the industry. We want to see a higher level of consumer protection in retail financial markets\, where firms compete vigorously in consumers’ interests. Firms need to understand their customers’ needs and to have the flexibility to support them with certainty of our expectations\, so they get good outcomes.” PS 22/9 – July 2022 \nCP 21/13 originally set the scene for us back in the summer of 2021\, laying out the FCA’s thinking\, and CP 21/36 delivered feedback on the initial paper\, whilst also firming up on the regulator’s thinking. SUMMARY:How will Senior Managers rise to the challenge in implementing the new Consumer Duty?
DESCRIPTION:The new Consumer Duty proposed by the FCA will place the responsibilities of a firm to avoid foreseeable customer harm squarely on the shoulders of Senior Managers and board members. There’s no ifs or buts on this as the regulator plans to hold Senior Managers accountable for assessing whether the firm is delivering good outcomes for its’ customers\, consistent with the Consumer Duty. The new Consumer Duty\, whilst currently in consultation\, will likely see the FCA publish feedback and a final policy statement on the matter in the summer of 2022\, with the rules likely to have to be implemented by April 2023 as it stands. The financial services regulators have for some time now identified Operational Resilience as a cross-sector issue and it has been a key feature of their Business Plans for 20/21 and 21/22. \nInterestingly the FCA/PRA and the Bank of England have co-ordinated their approach to this particular topic which will give people a view of the importance of this topic to all regulators\, by issuing their Policy Statements at the end of Quarter One of 2021. The expectations as laid out in these policy statements are far reaching and shows firms that there is a lot of work to do to ensure that they are ready when the regulatory deadlines come round in 2022 and 2025. It is also not a coincidence that the PRA simultaneously issued its Policy Statement on Outsourcing and Third Party Risk Management. DESCRIPTION:SM&CR has been part of the regulatory landscape for Banking & Insurance for 5 years now and much less so for FCA solo regulated firms.
