DESCRIPTION:With only a few months before the new Consumer Duty becomes a reality for most firms\, preparations should be moving into their final phases. DESCRIPTION:On 9 December 2022\, the UK Chancellor of the Exchequer announced a package of reforms to the UK financial services sector\, known as the “Edinburgh Reforms”. The aim of these reforms is to support the government’s ambitions for the UK to be the “world’s most innovative and competitive global financial centre.” There are a total of 30 reform proposals within the Edinburgh Reforms\, a review of SM&CR being one of them. At present\, little has been confirmed as to what the review of the SMCR will include. DESCRIPTION:In July\, the FCA confirmed their plans to introduce a new Consumer Duty that will set higher and clearer standards of consumer protection across financial services and require firms to put their customers’ needs first. \nThe FCA regards the Consumer Duty as a shift to an outcomes-focused approach that will provide an opportunity for greater competition\, growth\, and innovation amongst regulated firms. We want to see a higher level of consumer protection in retail financial markets\, where firms compete vigorously in consumers’ interests. DESCRIPTION:Through the recently published policy statement (PS 22/9) and finalised guidance (FG 22/5) the FCA have set out their requirements for the new Consumer Duty. DESCRIPTION:The newly proposed Consumer Duty (CD) is a topic on everyone’s agenda at the moment. With an increased focus on the end consumer and a key consideration being how firms treat their most vulnerable customers\, the Financial Conduct Authority (FCA) has clearly laid out its expectation in not one\, but two consultation papers on this particular topic. \nCP 21/13 set the scene\, laying out the FCA’s thinking and asking for views from regulated firms and CP 21/36 delivered feedback on the initial paper\, whilst also delivering more focused thinking from the FCA on what the new CD would bring to firms and individuals alike. With the Policy Statement likely to hit our desks at some point before the end of July\, this will be the first of a two part series\, where we initially consider the published CPs and discuss what this means from a personal perspective\, with the second part of the series (to be broadcast in Q3) considering the Policy Statement when published. \nThe FCA have clearly stated that the aim for introducing the new Consumer Duty is to drive a fundamental shift in industry mindset\, but what does this really mean and what part does each individual\, regardless of their role and status within an organisation\, have to play in this? DESCRIPTION:Now that the FCA’s plans for the new Consumer Duty have started to sink in\, firms are galvanising their project teams and starting their Gap Analyses. However\, whilst there is a lot of talk and discussion about the new principle for business\, cross cutting rules and new conduct rules\, there appears to be very little discussion at this stage about the over-arching role of “employee competence.” The Worksmart team\, and guests\, want to get the discussion going and hopefully with a bit of lively debate consider the implications of the new Consumer Duty from a wider Training & Competence perspective.
