DESCRIPTION:The new Consumer Duty proposed by the FCA will place the responsibilities of a firm to avoid foreseeable customer harm squarely on the shoulders of Senior Managers and board members. There’s no ifs or buts on this as the regulator plans to hold Senior Managers accountable for assessing whether the firm is delivering good outcomes for its’ customers\, consistent with the Consumer Duty. The new Consumer Duty\, whilst currently in consultation\, will likely see the FCA publish feedback and a final policy statement on the matter in the summer of 2022\, with the rules likely to have to be implemented by April 2023 as it stands. DESCRIPTION:Operational resilience has been thrust higher up the regulatory agenda over the last 12/18 months as firms and individuals alike have had to completely re-engineer the way they have operated through the Covid crisis. The financial services regulators have for some time now identified Operational Resilience as a cross-sector issue and it has been a key feature of their Business Plans for 20/21 and 21/22. \nInterestingly the FCA/PRA and the Bank of England have co-ordinated their approach to this particular topic which will give people a view of the importance of this topic to all regulators\, by issuing their Policy Statements at the end of Quarter One of 2021. The expectations as laid out in these policy statements are far reaching and shows firms that there is a lot of work to do to ensure that they are ready when the regulatory deadlines come round in 2022 and 2025. It is also not a coincidence that the PRA simultaneously issued its Policy Statement on Outsourcing and Third Party Risk Management. DESCRIPTION:SM&CR has been part of the regulatory landscape for Banking & Insurance for 5 years now and much less so for FCA solo regulated firms. But even some banks and insurance firms remain uncertain around how best to align the requirements within their organisations and evidence suggest that remains the case for many solo regulated firms too. \nNow that FCA solo regulated firms have passed the deadlines for both Directory Submissions and the first round of internal Certifications\, focus should be shifting to embedding the regime and completing the transition of SM&CR requirements into “Business as Usual.” From experience\, the team at Worksmart know this can be challenging; a good proportion of firms found that they were either extremely stretched by the March 21 deadlines\, or in some cases unable to complete those tasks within the set time limits. \nThat haste to meet the deadlines resulted in last minute decisions\, compromises\, and work arounds; many organisations having implemented short term solutions that will probably not pass the test of time in terms of efficiency\, reliability or sustainability. So there remains work to be done.
